Terms of Service
These Terms of Service (the "Terms") set out the conditions for using the mobile application "Mineral Note" and its related web services (collectively, the "Service") provided by Cobolabo (the "Provider"). By using the Service, users (each, a "User") agree to be bound by these Terms. This English version is provided for reference; in case of any inconsistency, the Japanese version shall prevail.
Article 1 (Application)
These Terms apply to all relationships between the Provider and Users regarding the use of the Service and govern the rights and obligations of both parties.
Article 2 (User Registration)
Anyone wishing to use the Service shall apply for registration through the method designated by the Provider after agreeing to these Terms.
The Provider may, at its discretion and without disclosing the reason, decline a registration application if any of the following applies:
- The applicant has submitted false information.
- The applicant has previously breached these Terms.
- The Provider otherwise determines the registration to be inappropriate.
Article 3 (Account Management)
Users shall manage their account information at their own responsibility.
The Provider shall not be liable for any damages arising from inadequate management, misuse, or use by third parties of the User’s account.
Article 4 (Prohibited Conduct)
Users shall not engage in any of the following while using the Service:
- Acts that violate laws, regulations, or public order and morals.
- Acts related to criminal activity.
- Acts that infringe on the intellectual property, portrait rights, privacy, reputation, or other rights or interests of the Provider, other Users, or third parties.
- Acts that place excessive load on the Service’s servers or network.
- Acts that interfere with the operation of the Service.
- Acts of collecting or accumulating personal information about other Users.
- Acts of impersonating another User.
- Posting obscene, violent, discriminatory, or otherwise seriously objectionable content ("Objectionable Content").
- Harassing, threatening, defaming, or otherwise abusing other Users.
- Advertising, promotion, or solicitation not permitted by the Provider.
- Posting content that encourages or recommends acts contrary to local laws, ordinances, or the wishes of the landowner with respect to nature, collection sites, private property, or protected areas (including unauthorized collection or entering off-limits areas).
- Any other acts that the Provider deems inappropriate.
Article 5 (User Content)
Users represent and warrant that they have the lawful right to post or transmit any content (including photos, text, location data, and similar materials; "User Content") to the Service, and that such User Content does not infringe the rights of third parties.
Users grant the Provider and its successors or licensees a non-exclusive, royalty-free license to use the User Content (including reproduction, public transmission, and adaptation) to the extent necessary to provide, improve, or promote the Service.
The Provider may, without prior notice, delete or hide User Content that it deems to be in violation of these Terms.
The Provider has zero tolerance for Objectionable Content and for abusive Users. Users may report Objectionable Content through the in-app reporting feature and may block abusive Users. Upon receiving a report or otherwise determining content to be objectionable, the Provider will promptly remove or hide such content and may restrict or terminate the account of the responsible User.
Article 6 (Location Information)
The Service collects and stores location information based on the User’s consent for purposes such as recording collection spots.
Users shall exercise discretion when sharing location information, particularly with regard to protecting rare species, the natural environment, and private property.
Article 7 (Suspension of the Service)
The Provider may suspend or interrupt all or part of the Service without prior notice to Users in any of the following cases:
- When performing maintenance or updates to the systems underlying the Service.
- When provision of the Service becomes difficult due to force majeure such as earthquake, lightning, fire, power outage, or natural disaster.
- When computers or communication lines have stopped due to an accident.
- Other cases where the Provider determines that the Service cannot reasonably be provided.
Article 8 (Usage Restrictions and Deregistration)
The Provider may, without prior notice, restrict a User’s use of all or part of the Service or cancel a User’s registration in any of the following cases:
- The User has breached any provision of these Terms.
- It becomes clear that the registration contains false information.
- Other cases where the Provider deems the use of the Service to be inappropriate.
Article 8-2 (Effect of Measures and Appeals)
When the Provider takes any measure set out in the preceding article, the affected User may be unable to access all or part of the Service.
A User who wishes to contest such a measure may submit an inquiry through the contact channel designated by the Provider. The Provider will review the submission and determine the appropriate response, retaining final discretion over whether to maintain, modify, or lift the measure.
Article 9 (Withdrawal)
Users may withdraw from the Service through the procedure designated by the Provider. Upon withdrawal, the Provider shall delete the User’s related data in accordance with its policies.
Article 10 (Disclaimer)
The Provider makes no express or implied warranty that the Service is free from defects (including those related to safety, reliability, accuracy, completeness, fitness for a particular purpose, security, errors, bugs, or rights infringement).
Information about mineral identification provided through the Service is intended as a reference only, and the Provider does not warrant its accuracy, completeness, or usefulness.
Except in cases of willful misconduct or gross negligence on the part of the Provider, the Provider shall not be liable for any damages suffered by Users in connection with the Service.
Article 11 (Changes to the Service)
The Provider may change or discontinue the Service without notice to Users and shall not be liable for any damages caused to Users thereby.
Article 12 (Changes to These Terms)
The Provider may amend these Terms at any time without prior notice. If a User continues to use the Service after such amendment, the User is deemed to have agreed to the revised Terms.
Article 13 (Personal Information)
Personal information obtained through the use of the Service shall be handled in accordance with the Provider’s Privacy Policy.
Article 14 (Notices)
Notices and communications between the User and the Provider shall be made through the means designated by the Provider.
Article 15 (No Assignment)
Users may not assign or pledge as security their position under the user agreement or any rights or obligations under these Terms to any third party without the prior written consent of the Provider.
Article 16 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan.
Any dispute arising out of or relating to the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Provider.
